Dear Neighbors,
The County of Santa Clara invites you to participate in developing alcohol
and drug prevention programs in our community. It has just been announced
that there are funds to encourage these types of programs and it is
important that we pull together to help prevent alcohol and drug related
problems any way we can.
Please take the time to join the County for one of their meetings. District
Two's County representative, Supervisor Don Gage, is hosting his alcohol and
drug prevention community meeting on Friday, May 20, 2005 from 3:00 - 4:30
p.m. It will be held at the Gilroy One Stop - 7800 Arroyo Circle - Gilroy,
CA 95020.

The San José City Council will conduct a public hearing on proposed changes to the Parkland Dedication Ordinance (Chapter 19.38 of the San José Municipal Code), the Park Impact Ordinance (Chapter 14.25 of the San José Municipal Code) and the associated Fee Resolution at its scheduled meeting on June 7, 2005 at 7:00 p.m. in Council Chambers of City Hall, 801 North First Street, Room 205, San José.

There will be opportunity to present written and oral comments on the proposed changes recommended by staff to the Council for continuation of the SRO units as a housing type, use the U.S. 2000 Census data for household sizes, provide credits for recreational trails, urban plazas, public gardens, garden plots, dog runs, and joint use of water detention areas. Projects within the downtown core area would not be subject to the active recreational element requirements in order to be eligible for private recreational credits. Set the in-lieu fees associated with the PDO and PIO at 85% of the residential land values within the City of San José.

Ed Rast, 2005 Chair of United Neighborhoods of Santa Clara County, will
repeat the UNSCC Insurance / Meeting & Event Training for those member
association Officers / Directors who haven't yet taken it.

All UNSCC member associations who have NOT attended the Insurance / Meeting
& Event Risk Management Training session will NOT be allowed to routinely
submit Special Event Insurance request until they either 1) attend the
annual training or 2) meet with the Board to submit their request for
special event insurance coverage.

UNSCC's Board is gradually ( March - July 2005) implementing our Meeting and
Special Event Risk Management Program so we can continue to provide our
members low cost member association group commercial liability insurance
coverage and have our member associations provide safe well organized
meetings and special events. Many of our member association Officers,
Directors and Event Participants do not understand the necessary
requirements and procedures to have safe meetings and special events or
control and share insurance and financial risks.

UNSCC member associations are still covered until
July 1, 2005, under our
group insurance policy for routine Member and Board of Directors meetings
with invited prospective members and invited speakers as long as the meeting
activities are not those defined as  moderate or high risk activates
requiring Special Event insurance coverage as part of UNSCC member services
if they have 1) paid their 2005 membership dues and 2) are a participating
member in " good standing "  as defined by the bylaws which included having
your Officers and Directors participate in UNSCC-MEMBERS which is UNSCC's
official method of communication to member associations.

After
July 1, 2005, ALL UNSCC member associations will be required to 1)
attend an annual UNSCC Insurance / Meeting & Event Risk Management Training
session and 2) submit a  UNSCC Event Insurance Request Form for all routine
member and Board of Director meetings between
July 1, 2005 to July 31, 2006
to be covered under UNSCC group insurance policy for insurance company
underwriter defined routine Member and Board of Directors meetings with
invited prospective members and invited speakers.

Special Event Insurance Request will continued to be submitted and billed to
member associations separately.

UNSCC Insurance / Meeting & Event Training session  will discuss our
insurance company's booklet  "Sound Advise for Functions and Events" and
it's recommendations about reducing meeting and event organizers, member
association Officers & Directors and UNSCC's insurance and financial risks
or sharing these risks with meeting and event participants, suppliers or
vendors.

Haven Neighbors Meeting

All Haven neighbors are welcome to attend our Haven Neighborhood Association meetings. We are not a homeowners association, but a friendly group of neighbors talking about neighborhood safety.
This meeting will feature talks on Personal Finance, and Graffiti abatement. We will also approve the new by-laws and elect the board.
Thanks to the Boys and Girls Club for hosting us! Please consider donating to the B&G club. They are our front line defense against gangs.

New By-Laws
These by-laws are the way the HNA operates. These rules were written to provide flexibility. To confirm these new by-laws, be present at the next meeting and voice your opinion.

HAVEN NEIGHBORHOOD ASSOCIATION
BY-LAWS
Version 2.0 - In Force May 1, 2005
Article I
NAME
The name of this association shall be: “Haven Neighborhood Association,” (referred throughout this document as HNA) is located in the City of San Jose, Santa Clara County, California. The northwest boundary of the Haven Neighborhood Association is Skyway Drive. The southwest boundary is Monterey Road and the southeast boundary is East Branham Lane. The northeast boundary is Houndshaven and all of the attached streets excepting Branham and Skyway. On the northeast corner of Monterey and Branham is an affordable housing rental complex (referred throughout this document as the COMPLEX).
Article II
MISSION
The HNA mission is neighborhood safety.
Article III
MEMBERSHIP
Any person 18 years or older who resides, owns property, or owns or operates a business within the boundaries of the article I is eligible to participate in the HNA, with the exception of the owners and management of the COMPLEX. Renters in the COMPLEX are eligible.

Article IV
BOARD OF OFFICERS
There shall be three (3) permanent officers: a President, Vice President and Treasurer. There is no term limit and each position may be placed up for election at any regular meeting by majority vote. If a vacancy should occur in between meetings, the board will appoint and confirm at the next regular meeting.
Article V
Roles and Responsibilities
1. President shall oversee the association, preside over meetings, vote and direct. The President shall be the primary co-signer along with the Treasurer.
2. Vice President shall perform the duties of the president in his/her absence or as directed. The Vice President administers the elections and is the secondary co-signer of checks.
3. Treasurer is the custodian of HNA funds, maintaining financial records, insurance records, votes, and acts as controller of funds.

Voting shall be allowed via official communication if warranted and feasible. All motions shall be decided by majority. If the vote results in a tie, the motion fails. The presiding board member can choose to delay any vote once until the next regular meeting.
Article VI
MEETINGS
Regular HNA meetings are held once a quarter or as amended by the board. Board meetings occur once a quarter as well. Regular meetings are not open to the general public. They are only available to members. Changes to regular meeting schedules must occur with (2) weeks notice or all votes are subject to confirmation at the subsequent regular meeting.
Board meetings may be attended electronically, by proxy or letter. Board meetings can be attended by any member, and anyone present at a board meeting can vote. A board meeting be called at any time, but all votes must be confirmed at a regular meeting unless the board meeting was held with seven (7) days notice to the HNA.
A quorum at any meeting is defined when two out of three board members are present (including by proxy) OR any three members at a regular meeting (that hasn’t been rescheduled) and the first order of business is to elect a new board from the attendees and a board member has not communicated that the meeting is canceled.
Article VII
OFFICIAL COMMUNICATION AND VOTING
A member can communicate outside of a meeting in one of four ways:
1. Email to the official HNA email address.
2. Post a comment on then HNA web site.
3. Post a bill on the HNA bulletin board.
4. Write a note to a standing board member.

Article VIII
AMENDMENTS TO BY-LAWS
Any changes to the BY-LAWS can be made by a vote at a regular meeting.
Article IX
DISSOLUTION
The property of the HNA is not the personal property of any member. It is held to meet the HNA mission. The possession of HNA property shall not be to the personal benefit of any member.

The HNA shall be dissolved if and when four consecutive regular HNA meetings are held without attendance. After the fourth meeting, any HNA assets shall be used to recover any outstanding debt or liability. The board shall decide which outside community group shall receive any remaining HNA assets.
Article X
LIMITS OF LIABILITY
Any person eighteen (18) years or older (“Adult”) attending the HNA meetings and/or HNA events do so at their own risk. If there are persons under the age of eighteen (18) years (“Minor”), they shall be accompanied by an Adult who is wholly responsible for the Minor. In the event of damage to tangible property, bodily injury or death, neither the Board nor the HNA shall be held liable. The board is not personally liable for the debts, liabilities, or other obligations of the HNA.
